4、tion sources in a scientific and efficient way and ensuring the accuracy and timeliness of the result data, this Regulation is formulated in accordance with the Statistics Law of the Peoples Republic of China and the Environmental Protection Law of the Peoples Republic of China. 第一条 为了科学、有效地组织实施全国污染
5、源普查，保障污染源普查数据的准确性和及时性，根据中华人民共和国统计法和中华人民共和国环境保护法，制定本条例。Article 2 The task of the national general survey of pollution sources shall be knowing the number of pollution sources and their distribution in different industries and regions, knowing the generation, discharge and treatment of major pollutant
6、s, establishing files for key pollution sources, a pollution source information database and an environmental statistics platform, to provide basis for formulating policies and plans for economic and social development and environmental protection. 第二条 污染源普查的任务是，掌握各类污染源的数量、行业和地区分布情况，了解主要污染物的产生、排放和处理
7、情况，建立健全重点污染源档案、污染源信息数据库和环境统计平台，为制定经济社会发展和环境保护政策、规划提供依据。Article 3 The term “pollution source” as mentioned in this Regulation refers to premises, facilities and equipment which discharge pollutants to environment in the process of production, livelihood or any other activity or have adverse impact on
8、 environment, as well as other sources giving birth to pollution. 第三条 本条例所称污染源，是指因生产、生活和其他活动向环境排放污染物或者对环境产生不良影响的场所、设施、装置以及其他污染发生源。Article 4 The national general survey of pollution sources shall be implemented under unified leadership, with departments cooperating based on division of function, with
9、 local peoples governments at different levels taking different responsibilities and with the participation of all circles. 第四条 污染源普查按照全国统一领导、部门分工协作、地方分级负责、各方共同参与的原则组织实施。Article 5 Expenses necessary for the national general survey of pollution sources shall be paid jointly by the Central Government
10、and the local peoples governments at various levels, be listed into the fiscal budget of the corresponding year and be put in position in time and in full amount. Expenses for the national general survey of pollution sources shall be under unified management, used for designated purpose only and und
11、er strict control. 第五条 污染源普查所需经费，由中央和地方各级人民政府共同负担，并列入相应年度的财政预算，按时拨付，确保足额到位。污染源普查经费应当统一管理，专款专用，严格控制支出。Article 6 The national general survey of pollution sources shall be conducted once every 10 years, more specifically, on December 31st of the survey year. 第六条 全国污染源普查每10年进行1次，标准时点为普查年份的12月31日。Article
12、 7 Newspapers, periodicals, broadcasting stations, TV stations, network and other news media shall report and publicize the general survey in a timely manner. 第七条 报刊、广播、电视和互联网等新闻媒体，应当及时开展污染源普查工作的宣传报道。Chapter II Object, Scope, Content and Method第二章 污染源普查的对象、范围、内容和方法Article 8 The object of the nationa
13、l general survey of pollution sources shall be entities and self-employed households which have pollution sources within the borders of the Peoples Republic of China. 第八条 污染源普查的对象是中华人民共和国境内有污染源的单位和个体经营户。Article 9 The object of the national general survey of pollution sources has the obligation to su
14、bject itself to the investigation conducted by the leading group office of the national general survey of pollution sources and its working personnel, report the true situation, provide the relevant materials and fill in the survey form in accordance with the relevant requirements. No object may del
15、ay the report of the data needed by the general survey, make false reports, hide the truth in making reports or refuse to report; or shuffle, refuse or impede the investigation; or transfer, conceal, alter or destroy raw material consumption records, production records, pollution control facility op
16、eration records, pollutant discharge monitoring records and other source material related to the generation or discharge of pollutants. 第九条 污染源普查对象有义务接受污染源普查领导小组办公室、普查人员依法进行的调查，并如实反映情况，提供有关资料，按照要求填报污染源普查表。污染源普查对象不得迟报、虚报、瞒报和拒报普查数据；不得推诿、拒绝和阻挠调查；不得转移、隐匿、篡改、毁弃原材料消耗记录、生产记录、污染物治理设施运行记录、污染物排放监测记录以及其他与污染物产生
17、和排放有关的原始资料。Article 10 The scope of the general survey of pollution sources shall include: industrial pollution sources, agricultural pollution sources, domestic pollution sources, facilities for centralized treatment of pollution and other facilities generating or discharging pollutants. 第十条 污染源普查范围
18、包括：工业污染源，农业污染源，生活污染源，集中式污染治理设施和其他产生、排放污染物的设施。Article 11 The main contents of the general survey on industrial pollution sources shall include: enterprises basic registration information, situation about raw material consumption, production situation, situation about the facilities giving rise to pol
19、lution, situation about the generation, control, discharge and comprehensive utilization of various kinds of pollutants, and situation about the construction and operation of various kinds of pollution prevention and control facilities. The main contents of the general survey on agricultural polluti
20、on sources shall include: scale of agricultural production, situation about water use and drainage, situation about the use of fertilizer, pesticide, feedstuff, feedstuff additives, agricultural film and other products input in agriculture, situation about the disposal of straw and other planting re
21、siduals, and situation about the generation and treatment of pollutants from livestock and poultry breeding industry. The main contents of the general survey on domestic pollution sources shall include: basic information about entities engaging in the tertiary industry, situation about the generatio
22、n, discharge and control of pollutants, situation about the discharge of pollutants by automotive vehicles, situation about urban domestic energy structure and consumption, situation about domestic water supply volume and displacement, and situation about domestic pollutant discharge, etc.The main c
23、ontents of the general survey on facilities for concentrated treatment of pollution shall include: basic situation and operation status of such facilities, situation about the treatment and disposal of pollutants, and situation about the generation, disposal and utilization of percolate, sludge, bur
24、ning residue and waste gases, etc. 第十一条 工业污染源普查的主要内容包括：企业基本登记信息，原材料消耗情况，产品生产情况，产生污染的设施情况，各类污染物产生、治理、排放和综合利用情况，各类污染防治设施建设、运行情况等。农业污染源普查的主要内容包括：农业生产规模，用水、排水情况，化肥、农药、饲料和饲料添加剂以及农用薄膜等农业投入品使用情况，秸秆等种植业剩余物处理情况以及养殖业污染物产生、治理情况等。生活污染源普查的主要内容包括：从事第三产业的单位的基本情况和污染物的产生、排放、治理情况，机动车污染物排放情况，城镇生活能源结构和能源消费量，生活用水量、排水量以及
25、污染物排放情况等。集中式污染治理设施普查的主要内容包括：设施基本情况和运行状况，污染物的处理处置情况，渗滤液、污泥、焚烧残渣和废气的产生、处置以及利用情况等。Article 12 The specific scope and contents of each general survey of pollution sources shall be determined according to the general survey plan approved by the State Council. 第十二条 每次污染源普查的具体范围和内容，由国务院批准的普查方案确定。Article 13
26、The general survey of pollution sources shall be conducted by way of overall statistical survey, and the method of sampling survey may be taken when necessary.The general survey of pollution sources shall follow the nationally unified standards and technical requirements. 第十三条 污染源普查采用全面调查的方法，必要时可以采用
27、抽样调查的方法。污染源普查采用全国统一的标准和技术要求。Chapter III Organization and Implementation of the General Survey of Pollution Sources第三章 污染源普查的组织实施Article 14 The leading group of the national general survey of pollution sources shall take charge of leading and coordinating the national general survey work. The office
28、of the leading group of the national general survey of pollution sources shall be in the administrative department of environmental protection of the State Council, and take charge of the daily work of the national general survey of pollution sources.第十四条 全国污染源普查领导小组负责领导和协调全国污染源普查工作。全国污染源普查领导小组办公室设在
29、国务院环境保护主管部门，负责全国污染源普查日常工作。Article 15 The leading groups of the general survey of pollution sources of the local peoples governments at or above the county level shall, in accordance with the unified provisions and requirements of the leading group of the national general survey of pollution sources,
30、 lead and coordinate the general survey work of their respective administrative regions. The leading group office of the general survey of pollution sources (hereinafter referred to as leading group office) under a local peoples government at or above the county level shall be in the administrative
31、department of environmental protection at the same level, and shall take charge of the daily general survey work of this administrative region. The peoples governments of villages (towns), sub-district offices and villagers (neighborhood) committees shall mobilize and organize social forces to activ
32、ely participate in and earnestly do a good job in the general survey of pollution sources. 第十五条 县级以上地方人民政府污染源普查领导小组，按照全国污染源普查领导小组的统一规定和要求，领导和协调本行政区域的污染源普查工作。县级以上地方人民政府污染源普查领导小组办公室设在同级环境保护主管部门，负责本行政区域的污染源普查日常工作。乡（镇）人民政府、街道办事处和村（居）民委员会应当广泛动员和组织社会力量积极参与并认真做好污染源普查工作。Article 16 The administrative departm
33、ent of environmental protection and other related departments of the peoples government at or above the county level shall, according to the division of work and the unified requirements of the leading group, get all work related to the general survey of pollution sources well done. 第十六条 县级以上人民政府环境保
34、护主管部门和其他有关部门，按照职责分工和污染源普查领导小组的统一要求，做好污染源普查相关工作。Article 17 The plan for the general survey of pollution sources shall be drafted by the leading group office of the national general survey of pollution sources under the State Council (hereinafter referred to as the leading group office under the State
35、 Council), and reported to the State Council for approval after it is examined and approved by the leading group of the national general survey of pollution sources. The plan shall include: the specific scope and contents of the general survey, the major pollutants to be inspected in the general sur
36、vey, the procedures and methods for the general survey, the organization and implementation of the general survey and the appropriation budget, etc. When drafting a plan for the national general survey of pollution sources, the opinions from the related departments and experts shall be fully heard.
37、第十七条 全国污染源普查方案由全国污染源普查领导小组办公室拟订，经全国污染源普查领导小组审核同意，报国务院批准。全国污染源普查方案应当包括：普查的具体范围和内容、普查的主要污染物、普查方法、普查的组织实施以及经费预算等。拟订全国污染源普查方案，应当充分听取有关部门和专家的意见。Article 18 The leading group office under the State Council shall draw out the general survey table in accordance with the plan for the national general survey o
38、f pollution sources, and submit the table to the National Bureau of Statistics for appraisal. The leading group office under the local peoples government of a province, autonomous region or municipality directly under the Central Government may add an attached list of the general survey of pollution
39、 sources for this administrative region to use, and use the list after it is approved by the leading group office under the State Council. 第十八条 全国污染源普查领导小组办公室根据全国污染源普查方案拟订污染源普查表，报国家统计局审定。省、自治区、直辖市人民政府污染源普查领导小组办公室，可以根据需要增设本行政区域污染源普查附表，报全国污染源普查领导小组办公室批准后使用。Article 19 At the initiation phase of the gen
40、eral survey, the leading group office shall check all entities. The departments in charge of government body organization, civil affairs, industry and commerce and quality inspection as well as other departments with functions of examination and approval or registration under the peoples government
41、at or above the county level shall provide entities information approved or registered by them to the leading group office at the same level, and assist the latter in the work of checking over entities. The leading group office shall, on the basis of the existing directory of entities of this admini
42、strative region and other such information provided by related departments, check and verify pollution sources one by one in accordance with the specific scope of the general survey as specified in the national general survey plan of pollution sources so as to form a directory of entities subject to
43、 the general survey of pollution sources. 第十九条 在普查启动阶段，污染源普查领导小组办公室应当进行单位清查。县级以上人民政府机构编制、民政、工商、质检以及其他具有设立审批、登记职能的部门，应当向同级污染源普查领导小组办公室提供其审批或者登记的单位资料，并协助做好单位清查工作。污染源普查领导小组办公室应当以本行政区域现有的基本单位名录库为基础，按照全国污染源普查方案确定的污染源普查的具体范围，结合有关部门提供的单位资料，对污染源逐一核实清查，形成污染源普查单位名录。Article 20 Any of the mid and large-scale in
44、dustrial enterprises listed into the scope of the general survey of pollution sources shall specify an agency to be responsible for filling in and reporting the general survey form, while other entities shall specify personnel to be responsible for such work. 第二十条 列入污染源普查范围的大、中型工业企业，应当明确相关机构负责本企业污染源
45、普查表的填报工作，其他单位应当指定人员负责本单位污染源普查表的填报工作。Article 21 The leading group office may, in light of the actual needs, hire people or borrow workers from related entities to engage in the general survey work. The leading group office shall conclude a labor contract with any person it hires, give remuneration to
46、 him and buy social insurance for him. A borrowed worker shall be paid by the entity hiring him, and the employee benefits shall remain the same. 第二十一条 污染源普查领导小组办公室可以根据工作需要，聘用或者从有关单位借调人员从事污染源普查工作。污染源普查领导小组办公室应当与聘用人员依法签订劳动合同，支付劳动报酬，并为其办理社会保险。借调人员的工资由原单位支付，其福利待遇保持不变。Article 22 A surveyor shall stick t
47、o the principle of being practical and realistic, scrupulously abide by the professional ethics and have professional knowledge needed for exercising his duties. The leading group office shall provide business trainings for surveyors, and issue the nationwide unified surveyors card to surveyors pass
48、ing the examination and evaluation. 第二十二条 普查人员应当坚持实事求是，恪守职业道德，具有执行普查任务所需要的专业知识。污染源普查领导小组办公室应当对普查人员进行业务培训，对考核合格的颁发全国统一的普查员工作证。Article 23 Surveyors shall independently exercise powers of investigation, reporting, supervision and inspection according to law, have the right to look up the raw material consumption record, production record, pollution control facility operation record, pollutant discharge monitoring re
