9、 the Law of the Peoples Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes as well as other laws and administrative regulations for the purpose of controlling and reducing the pollution caused by the wasted electronic information products to the environment, p

10、romoting the production and sale of low-pollution electronic information products, and protecting the environment and human health.第一条 为控制和减少电子信息产品废弃后对环境造成的污染，促进生产和销售低污染电子信息产品，保护环境和人体健康，根据中华人民共和国清洁生产促进法、中华人民共和国固体废物污染环境防治法等法律、行政法规，制定本办法。Article 2 Except for the production of products for export, the

11、control and reduction of the pollution and other public hazards caused by electronic information products to the environment in the process of production, sale and import of electronic information products within the territory of the Peoples Republic of China shall be governed by the present Measure

12、s.第二条 在中华人民共和国境内生产、销售和进口电子信息产品过程中控制和减少电子信息产品对环境造成污染及产生其他公害，适用本办法。但是，出口产品的生产除外。Article 3 In the present Measures, the following terms shall have their respective meanings as follows:(1) The term electronic information products shall refer to the products produced with electronic information technolog

13、ies, including electronic radar products, electronic communication products, radio and television products, computer products, home electronic products, electronic measurement devices products, special electronic products, electronic element and component products, electronic application products, e

14、lectronic material products, etc., as well as the parts and components thereof.(2) The term pollution of electronic information products shall refer to the destructions, damages, wastes or other bad effects caused to the environment, resources, human body, life or health, or the property safety due

15、to the toxic or noxious substances or elements contained in electronic information products, or due to the toxic or noxious substances or elements contained in electronic information products which exceed the national standards or industrial standards.(3) The term control of pollution from electroni

16、c information products shall refer to the following measures adopted to reduce or eliminate the toxic or noxious substances or elements contained in electronic information products:a. the technical measures of changing the research and design scheme, adjusting the workflow, replacing the materials o

17、r renovating the method of production, etc. in the process of design or production;b. the measures of indicating the names and contents of toxic or noxious substances or elements, indicating the environmental protection use life of the electronic information products, etc. in the process of design,

18、production, sale or import;c. the measures such as rigidly limiting the purchasing avenues, or refusing to sell the electronic information products which do not meet the national or industrial standards for the control of toxic or noxious substances or elements of electronic information products in

19、the process of sale;d. prohibiting the import of electronic information products which do not meet the national or industrial standards for the control of toxic or noxious substances or elements of electronic information products;e. other pollution control measures prescribed in the present Measures

20、.(4) The term toxic or noxious substances or elements shall refer to the following substances or elements contained in electronic information products:a. lead;b. hydrargyrum;c. cadmium;d. Hex Chrome;e. PBB;f. PBDE;g. other toxic or noxious substances or elements prescribed by the state.(5) The term

21、environmental protection use life of electronic information products shall refer to the time period within which the toxic or noxious substances or elements contained in electronic information products will not leak or suddenly change, and the users of the electronic information products will not ca

22、use serious pollution to the environment or serious personal or property damages.第三条 本办法下列术语的含义是：（一）电子信息产品，是指采用电子信息技术制造的电子雷达产品、电子通信产品、广播电视产品、计算机产品、家用电子产品、电子测量仪器产品、电子专用产品、电子元器件产品、电子应用产品、电子材料产品等产品及其配件。（二）电子信息产品污染，是指电子信息产品中含有有毒、有害物质或元素，或者电子信息产品中含有的有毒、有害物质或元素超过国家标准或行业标准，对环境、资源以及人类身体生命健康以及财产安全造成破坏、损害、浪费或

23、其他不良影响。（三）电子信息产品污染控制，是指为减少或消除电子信息产品中含有的有毒、有害物质或元素而采取的下列措施：1、设计、生产过程中，改变研究设计方案、调整工艺流程、更换使用材料、革新制造方式等技术措施；2、设计、生产、销售以及进口过程中，标注有毒、有害物质或元素名称及其含量，标注电子信息产品环保使用期限等措施；3、销售过程中，严格进货渠道，拒绝销售不符合电子信息产品有毒、有害物质或元素控制国家标准或行业标准的电子信息产品等；4、禁止进口不符合电子信息产品有毒、有害物质或元素控制国家标准或行业标准的电子信息产品；5、本办法规定的其他污染控制措施。（四）有毒、有害物质或元素，是指电子信息产品

24、中含有的下列物质或元素：1、铅；2、汞；3、镉；4、六价铬；5、多溴联苯（PBB）；6、多溴二苯醚（PBDE）；7、国家规定的其他有毒、有害物质或元素。（五）电子信息产品环保使用期限，是指电子信息产品中含有的有毒、有害物质或元素不会发生外泄或突变，电子信息产品用户使用该电子信息产品不会对环境造成严重污染或对其人身、财产造成严重损害的期限。（相关资料:相关论文1篇）Article 4 The Ministry of Information Industry of the Peoples Republic of China (hereinafter referred to as MII), the

25、 State Development and Reform Commission of the Peoples Republic of China (hereinafter referred to as SDRC), the Ministry of Commerce of the Peoples Republic of China (hereinafter referred to as MOC), the General Administration of Customs of the Peoples Republic of China (hereinafter referred to as

26、the General Administration of Customs), the State Administration for Industry and Commerce (hereinafter referred to as SAIC), the State Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as SAQSIQ), and the State Environmental Protection Administration (hereina

27、fter referred to as SEPA) shall, within the scope of their respective duties, administer and supervise the control of pollution from the electronic information products. They shall, when necessary, set up a work coordination mechanism to resolve the major matters and problems in the control of pollu

28、tion from electronic information products.第四条 中华人民共和国信息产业部（以下简称“信息产业部”）、中华人民共和国国家发展和改革委员会（以下简称“发展改革委”）、中华人民共和国商务部（以下简称“商务部”）、中华人民共和国海关总署（以下简称“海关总署”）、国家工商行政管理总局（以下简称“工商总局”）、国家质量监督检验检疫总局（以下简称“质检总局”）、国家环境保护总局（以下简称“环保总局”），在各自的职责范围内对电子信息产品的污染控制进行管理和监督。必要时上述有关主管部门建立工作协调机制，解决电子信息产品污染控制工作重大事项及问题。Article 5 M

29、II shall, in consultation with the relevant administrative department of the State Council, formulate measures favorable to the control of pollution from electronic information products.MII and the relevant administrative departments of the State Council shall, within the scope of their respective d

30、uties, spread the technologies on the control of pollution from electronic information products and the comprehensive utilization of resources, etc., encourage and support the scientific research, technological development and international cooperation on the control of pollution from electronic inf

31、ormation products, and ensure the implementation of the relevant provisions on the control of pollution from electronic information products.第五条 信息产业部商国务院有关主管部门制定有利于电子信息产品污染控制的措施。信息产业部和国务院有关主管部门在各自的职责范围内推广电子信息产品污染控制和资源综合利用等技术，鼓励、支持电子信息产品污染控制的科学研究、技术开发和国际合作，落实电子信息产品污染控制的有关规定。Article 6 MII may provide

32、 certain support to the organizations and individuals who actively develop, research and manufacture new environmental protection electronic information products.第六条 信息产业部对积极开发、研制新型环保电子信息产品的组织和个人，可以给予一定的支持。Article 7 The administrative departments of information industry, development and reform, comm

33、erce, customs, industry and commerce, quality inspection, environmental protection, etc. of each province, autonomous region, or municipality directly under the Central Government shall, within the scope of their respective duties, supervise and administer the control of pollution caused from produc

34、tion, sale and import of electronic information products, and shall, when necessary, set up a work coordination mechanism for regional control of pollution from electronic information products, uniformly coordinate their work and assume their respective responsibilities.第七条 省、自治区、直辖市信息产业，发展改革，商务，海关，

35、工商，质检，环保等主管部门在各自的职责范围内，对电子信息产品的生产、销售、进口的污染控制实施监督管理。必要时上述有关部门建立地区电子信息产品污染控制工作协调机制，统一协调，分工负责。（相关资料:地方法规1篇）Article 8 The administrative department of information industry of each province, autonomous region, or municipality directly under the Central Government may commend and award the organizations a

36、nd individuals that have made prominent achievements in the control of pollution from electronic information products and other relevant activities.第八条 省、自治区、直辖市信息产业主管部门对在电子信息产品污染控制工作以及相关活动中做出显著成绩的组织和个人，可以给予表彰和奖励。Chapter II Control of Pollution from Electronic Information Products第二章 电子信息产品污染控制Artic

37、le 9 An electronic information product designer shall, when designing electronic information products, meet the national or industrial standards for control of toxic or noxious substances or elements of electronic information products, and shall, on the premise of satisfying the technique requiremen

38、ts, adopt a non-toxic and innoxious or a low-toxicity and low-noxiousness solution in which the said substances or elements are easy to be degraded or convenient for recurrent utilization.第九条 电子信息产品设计者在设计电子信息产品时，应当符合电子信息产品有毒、有害物质或元素控制国家标准或行业标准，在满足工艺要求的前提下，采用无毒、无害或低毒、低害、易于降解、便于回收利用的方案。Article 10 An p

39、roducer of electronic information products shall, when producing or manufacturing electronic information products, meet the national or industrial standards for control of toxic or noxious substances or elements of electronic information products, and use the materials, technologies and techniques w

40、ith high resource utilization rate, easy for recycling and treatment, and beneficial to environmental protection.第十条 电子信息产品生产者在生产或制造电子信息产品时，应当符合电子信息产品有毒、有害物质或元素控制国家标准或行业标准，采用资源利用率高、易回收处理、有利于环保的材料、技术和工艺。Article 11 The environmental protection use life of electronic information products shall be deter

41、mined by the producer or importer of electronic information products itself. The producer or importer of electronic information products shall mark the environmental protection use life on the electronic information products it produces or imports, or shall, if the said use life cannot be marked on

42、the products due to the limited product size or function, indicate the reason in the product instructions.The indicated specimen and the way of indication, which are prescribed in the preceding paragraph, shall be uniformly prescribed by MII in consultation with the relevant administrative departmen

43、t of the State Council. The indicated specimen and the way of indication shall meet the national or industrial standards for control of toxic or noxious substances or elements of electronic information products.The relevant industrial organizations may, according to the technical development level,

44、formulate guidelines on the environmental protection use life of relevant electronic information products.第十一条 电子信息产品的环保使用期限由电子信息产品的生产者或进口者自行确定。电子信息产品生产者或进口者应当在其生产或进口的电子信息产品上标注环保使用期限，由于产品体积或功能的限制不能在产品上标注的，应当在产品说明书中注明。前款规定的标注样式和方式由信息产业部商国务院有关主管部门统一规定，标注的样式和方式应当符合电子信息产品有毒、有害物质或元素控制国家标准或行业标准。相关行业组织可根据技

45、术发展水平，制定相关电子信息产品环保使用期限的指导意见。Article 12 MII encourages the relevant industrial organizations to submit their guidelines on the environmental protection use life of their electronic information products to MII.第十二条 信息产业部鼓励相关行业组织将制定的电子信息产品环保使用期限的指导意见报送信息产业部。Article 13 A producer or importer of electron

46、ic information products shall mark the toxic or noxious substances or elements contained in the electronic information products it launches to the market, indicating the name and content of toxic or noxious substances or elements, the components contained, and whether they may be recycled for utiliz

47、ation, etc, or shall, if such information cannot be marked on the products due to the limited product size or function, indicate the reason in the product instructions.The indicated specimen and the way of indication, which are prescribed in the preceding paragraph, shall be uniformly prescribed by

48、MII in consultation with the relevant administrative department of the State Council, and shall meet the national or industrial standards on the control of toxic or noxious substances or elements contained in electronic information products.第十三条 电子信息产品生产者、进口者应当对其投放市场的电子信息产品中含有的有毒、有害物质或元素进行标注，标明有毒、有害物质或元素的名称、含量、所在部件及其可否回收利用等；由于产品体积或功能的限制不能在产品上标注的，应当在产品说明书中注明。前款规定的标注样式和方式由信息产业部商国务院有关主管部门统一规定，
